General Rental Conditions for Winter Sports Equipment

The rental contract is concluded between the booking customer and NTC Oberstdorf Sport Entertainment GmbH, Nebelhornstr. 67, 87561 Oberstdorf (hereinafter referred to as NTC) upon payment of the rental price. The landlord will not release the rental item until the rental price has been paid in full.

When booking online via a web shop, the rental price must be paid in full online. For renters, the booking becomes valid upon online payment and receipt of the booking confirmation; for NTC, upon receipt of the booking confirmation.

The rental price is only valid for consecutive days.

Even in cases of force majeure, particularly in the event of adverse weather conditions, the obligation to pay rent remains in place.

The rental can be cancelled free of charge up to 24 hours before the start of the rental period. After that, the full rental price will be charged. If the renter cancels after the rental period has started, there is no right to a refund of payments already made.

For bookings of groups of 8 or more people, special cancellation conditions apply: o Free of charge up to 5 days before the start of the rental period

o Up to 24 hours before the start of the rental period 50% of the total price

o On the day of rental 100% of the total price

In the event of injury or illness of the tenant during the rental period, provided that a medical certificate is presented and the rental item is returned immediately, no rent is payable from the time the medical certificate is issued and a refund will be made for the remaining rental period already paid.

Passing on the rental item to third parties is prohibited.

Before the rental item is returned, security must be provided. This can be an ID card, a credit card receipt or another identification document.

The tenant is liable for intent or gross negligence.

• The tenant should be adequately insured. The landlord assumes no liability for personal injuries to the tenant or third parties involved in damage.

The rental item is generally insured against breakage and theft. In the event of theft, the tenant must report it.

Intentional or malicious damage is excluded from insurance cover. Repair costs will be charged for malicious damage. The following are considered malicious: skiing/boarding on roads or gravel paths, skiing/boarding off the marked slopes, skiing/boarding across the car park. Accordingly, touring skis are generally excluded from insurance cover against breakage.

The rental price includes the free option to upgrade to another model in the same price range.

Rentals after 15.30:09.30 p.m. (excluding deposit) will only be charged from the following calendar day. If the rental item is returned before XNUMX:XNUMX a.m., the current calendar day will not be charged.

Ski boots are adjusted to the ski bindings, both rental items comply with the safety requirements of ISO standard 11088. However, when the rental item is handed over, a separate safety check and adjustment according to ISO/ÖNORM is not carried out. The ski bindings are adjusted by hand according to the ISO number.

No liability is accepted for accidents of any kind; in particular, the lessor is not liable for damages caused by incorrect information provided by the renter - especially in connection with the binding setting.

• The rental item is in a technically faultless condition and is regularly serviced. The renter has ensured this before starting the journey.

• The landlord will provide technical instructions and properly hand over the rental item.

• The landlord’s liability for property damage and personal injury is excluded after the rental agreement has been concluded.

• When the rental item is returned, it will be checked for any damage and completeness. If any damage occurs, this must be reported to the landlord upon return.

• In the event of late return, the full daily price of the rental item will be charged. If the rental item is not returned, a loss report will be filed. The latest return time is 17.30:XNUMX p.m. A fee will be charged for late return.

• NTC does not offer a pick-up service in the event of a breakdown. Breakdown kits are available to borrow free of charge.

Tenants' obligations

All rental items must be kept in perfect condition.

• The renter must ensure that the rental item is in perfect condition before setting off on the journey. Any defects or damage to or with the rental item and any theft must be reported to the lessor immediately.

• “NTC Guarantee Plus” – the renter is liable for damages with a maximum deductible of €150. This does not include damage to the rental property that is intentional or caused by gross negligence. The “NTC Guarantee Plus” only applies in the event of theft if the bike is locked. NTC therefore provides bicycle locks for hire free of charge.

• The tenant is liable for the rented items according to the principles of the German Civil Code (BGB). Damage that goes beyond normal wear and tear and is caused intentionally is the tenant's responsibility.

• The road traffic regulations must be observed.

• Driving under the influence of alcohol or drugs is prohibited.

• The renter is recommended to wear a helmet.

• Riding in bike parks with NTC rental bikes is prohibited.

repairs

If repairs are necessary, the landlord will bear the costs if the cause is neither due to improper handling by the tenants nor due to their fault. The tenants are responsible for the latter circumstances.

• Replacement costs will be charged for missing, damaged or lost parts.

• If there are any defects on the bike that prevent you from continuing your journey, the rental company must be notified immediately. A replacement bike will then be provided if possible and necessary.

Liability

The renter must return the bicycle in the same condition in which he received it.

• The renter is liable for culpable damage to the bicycle and for damage caused by the use of the bicycle, as well as for the breach of their contractual obligations.

• If a third party compensates the landlord for the damage, the tenants are released from their obligation to pay compensation.

General Terms and Conditions Ski School

Registration can be done in writing, verbally or online. Registration is always binding. Registration is valid as soon as it has been confirmed by the ski and snowboard school. Confirmation of registration does not require any special form.

If a group in a course with a specified minimum number of participants is reduced to less than 4 participants, we reserve the right to combine them or reduce the number of lessons.

Due to the flexible organization, multiple teacher changes are possible.

We accept no liability for accidents that occur during or before ski lessons. Accident and liability insurance is the responsibility of the course participants.

Refunds due to injury or illness are only possible with a doctor's confirmation. Only unused days (difference in price) will be refunded.

Course cancellations due to weather-related influences (force majeure) will not be reimbursed. Private courses take place in all weather conditions. The course ticket is not transferable. Course days not used will expire!

All deliveries and services of the ski school based on online orders via the Internet or other online services are subject to these terms and conditions.

The ski course fee does not include the use of the lifts. The ski school does not provide compensation for lessons missed due to cable car and lift failures.

You can withdraw from the course free of charge (without medical confirmation) up to 24 hours before the start of the course; after that, the full course price will be charged.
